I am being served foreclosure papers this week. (05/23/08)
 
 
  
          I have been in Seattle all week on business. I am sitting at the Seattle airport waiting to catch a flight back home, but it is not a completely sweet homecoming - a had a voicemail this week that I will be served papers for foreclosure on my home. If you have been reading my blogs for a while now (see 6 months, no payments, no papers), you know that this has been expected for some time now. My last payment on my home was November 2007. Of course, I have recently moved to a rental condo (see We Have Moved) while I wait for my golf course home to be foreclosed on so the house is currently empty. That takes away a little bit of worry about waiting for the sheriff to show up with padlocks (which I do not think they actually do until certain notices and time limits have been met).
 
          As I have already been served foreclosure papers on two of my condos, the clerk that serves the papers knows me and has my cell phone. She called to see when she could deliver the documents as she knows that I travel a lot. Monday is a holiday, so she will probably come to see me on Tuesday or Wednesday. If everything is the same as when I was served on the other two condos, I will have twenty (20) days to file papers with the court. My lawyer will do this (Have you talked with a lawyer? You should. See Seeking Legal Counsel). The form will be just as generic as the first two letters (see the first letter), and I could probably do them myself; but I feel more comfortable letting a lawyer file it for me. If I do the letter myself and do not write it and file it correctly according to the rule of law, I risk losing any protection that the law might afford me - meaning the mortgage company might come after my wages automatically or at least much more easily.
 
          While I have the letter as a document here on the web site (minus personal information, of course), I do not have the court papers from the first notice. I will, however, scan and put the foreclosure court papers from this week's notice on my blogs sometime this week (minus personal information, of course). For those of you waiting for foreclosure notices, you will probably find these pretty insightful. Check back later this week for these documents or, even better, sign up on the blog pages to be notified when I update my blog entries (see the subscribe option on the blog page).
