I Received a "Lien in Progress" Notice (06/24/08)

I received a "Lien in Progress" notice today against my primary residence - or at least what used to be my primary residence until I moved to my new rental apartment (Read 'We've Moved Out'). The amount is only $1,242.64, but I supposed it is more about the number of months behind rather than the amount. Of course, since Florida's Small Claims Court is limited to a $5,000.00 cap, they probably had to file it as their bill would not get anywhere near $5,000 before the house actually goes through foreclosure. These expenses are for my annual homeowner's association. A very similar thing happened against my two condos, only that was for condo association dues and special assessment fees (Read 'Small Claims Court'). I do not, however, ever remember any notice from the condos that said "Lien in Progress". The condos just had notices to pay; and then, suddenly, I was served papers for a small claims court appearance - of which I did not attend (See how that turned out). The only other notice that I expect would be from the county for not paying the property taxes on the house in which I had been living. That should happen pretty soon. It might even be that the county auctions off the house even before the bank forecloses on the house. Either way, I wish it would hurry up as I am still maintaining the utilities and cutting the grass on the property until it is out of my name even though it is vacant and I no longer live there.

What will happen with this lien? I am guessing that the lien will go against the property so that the homeowner's association can get their money back if the property ever sells because a property cannot be sold if it does not have a clear title. Will they come after me personally with this lien? I do not know. I guess they could, but I have not seen that yet. I will certainly keep you posted on what they do with this lien by updating this blog. You can sign-up for updates on the comments page for this entry. If you have had a similar situation, tell me how yours turned out. I'd love to hear. Thanks.
